Pemerintah Diimbau Tunda Penerapan Pajak E-Commerce

JAKARTA – Pemerintah diimbau menunda pelaksanaan Peraturan Menteri Keuangan (PMK) tentang Perlakuan Perpajakan Atas Transaksi Perdagangan Melalui Sistem Elektronik pada 1 April mendatang. Penundaan dinilai perlu agar ada cukup waktu bagi pemerintah untuk mengkaji lebih jauh, secara cermat dan hati-hati, mengenai dampak negatif dari kebijakan itu terhadap industri maupun pelaku e-commerce dan marketplace yang notabene merupakan industi baru.

“Jangan sampai penerapan PMK 210/2018 memukul ekonomi digital nasional,” kata Deputy Head of Research and Analysis Katadata Stevanny Limuria di Jakarta, Kamis (28/3/2019).

Dengan tujuan menciptakan kesetaraan di antara para pelaku ekonomi, pemerintah pada 31 Desember 2018 telah mengeluarkan PMK 210/2018. Regulasi ini akan berlaku efektif pada 1 April 2019 dan mewajibkan pedagang yang telah berstatus Pengusaha Kena Pajak (PKP) atau beromzet Rp4,8 miliar setahun untuk memungut PPN 10% dari pembeli dan selanjutnya menyetor Pajak Pertambahan Nilai (PPN) dan Pajak Penjualan Barang Mewah (PPnBM).

Sementara itu, untuk pedagang atau penyedia jasa yang belum berstatus PKP, tidak diwajibkan memungut PPN dari konsumen. Namun, diwajibkan menyetor Nomor Pokok Wajib Pajak (NPWP) dan Nomor Induk Kependudukan (NIK) kepada penyedia platform marketplace. Melalui kewajiban penyerahan NPWP dan NIK ini, pemerintah berharap akan terjadi perluasan basis wajib pajak.

Persoalannya, kata Stevanny, belum ada mekanisme yang efektif dan aturan terperinci mengenai penerapan aturan ini bagi media sosial. Padahal, sebagian besar transaksi e-commerce dilakukan via media sosial. Berdasarkan survei idEA pada 2017 di 10 kota di Indonesia, transaksi online melalui media sosial seperti Facebook dan Instagram mencapai 66%. Hanya 16% penjual dan pembeli yang menggunakan platform marketplace.

Menurut Stevanny, tingginya transaksi e-commerce di media-media sosial menunjukkan bahwa penerapan PMK 210/2018 sebagai upaya profiling dan memperluas basis wajib pajak dari merchant dan pedagang yang 99% merupakan pengusaha mikro, sulit tercapai.

Hal lain yang perlu dicermati, imbuh dia, kewajiban melaporkan NPWP dan NIK bagi pedagang dan penyedia jasa kepada penyedia platform marketplace dikhawatirkan akan mendorong perpindahan besar-besaran merchant dan para pedagang dari platform marketplace ke platform media sosial.

Sementara, pengamat perpajakan dari Center for Indonesian Taxation (CITA) Yustinus Prastowo menyoroti soal perlunya edukasi, khususnya kepada penjual di marketplace, bahwa fasilitas yang didapat oleh penjual e-commerce ketika mereka berdagang melalui media sosial akan sangat terbatas jika dibandingkan ketika mereka berdagang melalui platform marketplace.Terlebih lagi platform e-commerce seperti marketplace punya kelebihan, yakni jaminan keamanan, reputasi penjual, dan juga riwayat transaksi penjualan.
Menurut Yustinus, transaksi e-commerce di luar platform marketplace seperti online retail, classified ads, daily deals, atau media sosial sebenarnya bisa mengikuti ketentuan yang ada dalam PMK 210/2018. Namun, pemerintah perlu segera membuat peraturan lanjutan mengenai ketentuan perpajakan atas transaksi e-commerce via media sosial. “Ini agar terjadi equal treatment pelakuan perpajakan (terhadap semua platform e-commerce),” tegasnya.

Jika pemerintah belum bisa mengeluarkan regulasi lanjutan yang khusus mengatur ketentuan perpajakan untuk transaksi e-commerce di media sosial, sambung Stevanny, maka pemerintah ada baiknya menunda pelaksanaan PMK 210/2018 minimal selama dua tahun.”Waktu dua tahun bisa dipakai juga untuk mengedukasi kesiapan penjual e-commerce mengenai ketentuan perpajakan,” jelasnya.
